Colorado is right to fight ObamaCare

Colorado Attorney General John Suthers, criticized by The Denver Post editorial board and others for suing to block ObamaCare in March, got some vindication today.

“The success of a lawsuit in Virginia targeting the national health care reform law gave some legs Monday to a parallel suit that Colorado Attorney General John Suthers joined in March,” the the Gazette in Colorado Springs reported.

U.S. District Judge Henry Hudson ruled that the individual mandate to buy health insurance, including penalties for non-compliance, violates the commerce clause. Given rulings that back ObamaCare, the issue will likely be decided at some point by the U.S. Supreme Court.

Suthers described the constitutional stakes when addressing Adams County Republicans earlier this year, in a video posted by Veritas Consulting.

“Ladies and gentleman, never before in our history has the federal government attempted to regulate your economic inactivity, your failure to participate in the marketplace,” said Suthers. “And if this legislation is allowed to stand and the federal government can force you to buy any product or service they think is good for you, then there is no limit to the federal government’s control over your individual economic decision-making. They can make you buy the car…they want. They can make you…buy the food they want.”
